1. Definitions and acceptance of the Terms and Conditions

1.1. This website, including all its subdomains, sections, features, services, tools, platforms, integrated technologies such as 3D modeling, artificial intelligence, and virtual reality, and all other resources provided in this context (hereinafter, the “Website”), is operated and managed by Decohub SL (hereinafter, “DecoHub”), with Tax ID [B56415052], a legal entity duly established in accordance with the laws of Spain, with its address at [Ferlandina 40, ático 5 Barcelona].

1.2. The following Terms and Conditions (hereinafter, the “Terms”) govern the use of the Website and all functionalities, services, and products available on or through the Website. These Terms constitute a legally binding contract between you, the user (hereinafter, the “User”), and DecoHub in connection with the use of the Website.

1.3. By accessing, browsing, or using the Website in any way, the User fully accepts these Terms. The User also acknowledges and agrees that DecoHub may, at its absolute discretion, deny access to the Website to any User who violates these Terms.

1.4. If the User does not agree with these Terms or any part of these Terms, they must refrain from using the Website. The continued use of the Website after changes to the Terms have been posted will constitute the User’s acceptance of such changes.

2. Purpose and functionalities of the website.

2.1. The Website is an online platform specially designed to create a digital, immersive, and virtual environment that promotes the advertising, promotion, and sale of products and services in the field of decoration, design, architecture, and interior design (hereinafter, the “Sector”).

2.2. DecoHub provides through the Website a space where visibility is granted to brands, designers, companies, professionals, sponsors, and other participants in the Sector (hereinafter, the “Participants”). The Website aims to serve as a meeting platform between the Participants and Users interested in the Sector.

2.3. The Website allows Participants to showcase, promote, and sell their products and services, providing Users with a direct purchasing channel.

2.4. The Website integrates cutting-edge technologies, including but not limited to 3D modeling, artificial intelligence, and virtual reality. The use of these technologies aims to enhance the User’s experience, enabling dynamic interaction with the products and services offered, providing a unique and improved e-commerce experience.

2.5. Users may, through the Website, explore and purchase the offered products and services, interact with Participants, receive news and updates about the Sector, participate in forums and discussions, and take advantage of other functions and services that DecoHub may offer from time to time.

2.6. DecoHub reserves the right to modify, suspend, or discontinue any aspect of the Website at any time, including the availability of any feature, database, or content. DecoHub may also impose limits on certain features and services or restrict access to parts or all of the Website without prior notice or liability.

3. Requirements and Conditions for User Registration

3.1. To use certain features of the Website, such as interacting with Participants, participating in discussion forums, receiving personalized newsletters, and conducting commercial transactions, it may be necessary for the User to register for an account on the Website (hereinafter the “Account”).

3.4. DecoHub cannot and will not be responsible for any loss or damage caused by the User’s failure to meet these security obligations. However, the User may be responsible for losses suffered by DecoHub or any other User of the Website due to the use of their Account by another person.

3.5. By registering on the Website, the User agrees to receive periodic communications from DecoHub, which may include news or updates. If the User decides at any time that they do not wish to receive these communications, they can follow the instructions provided in such communications.

3.6. DecoHub reserves the right to suspend or cancel the User’s Account at any time and for any reason, including but not limited to, a violation of these Terms.

4. Terms of Use and User Conduct

4.1. By using the Website, the User agrees to comply with all applicable local, national, and international laws and regulations and not to infringe upon the rights of third parties or these Terms.

4.2. The User agrees not to use the Website for illegal, fraudulent, malicious, or prohibited purposes under these Terms. The User is responsible for all their activity in connection with the Website.

d. Publish or transmit any type of illegal, offensive, racist, harassing, defamatory, slanderous, fraudulent, obscene, indecent, or otherwise harmful content.

e. Forge headers or manipulate identifiers to conceal the origin of any content transmitted through the Website.

5. Exclusion of Warranties and Limitation of Liability

5.3. Use of the Website is at the User’s own risk. The User assumes full responsibility and risk of loss resulting from their use of the Website.

5.4. To the fullest extent permitted by applicable law, DecoHub disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.

5.5. b. Any transaction or relationship between the User and any Participant;

c. Any unauthorized access to or use of our servers and/or any personal information stored therein;

d. Any interruption or cessation of transmission to or from the Website;

e. Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Website by any third party; or

f. Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Website.

5.7. The User acknowledges that the limitations set forth in this section are fundamental elements of these Terms and the Website would not be provided to the User absent such limitations.

6. Privacy policy and data protection

6.1. The protection and respect of Users’ personal data are of utmost importance to DecoHub. All personal data that the User provides to DecoHub through the Website will be subject to our Privacy Policy.

No part of the Content may be copied, reproduced, distributed, republished, downloaded, displayed, published, or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, print, recording, or any other nature, without the prior written consent of DecoHub or the rights holder, except as provided by law.

Furthermore, the User agrees not to use, sell, resell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any Content or services obtained from the Website, including graphics and logos, in whole or in part, for any commercial or non-commercial purpose without the express written permission of DecoHub or the respective rights holder.

8. Policy on modifications and updates

8.1. DecoHub reserves the right to modify, update, add, delete, revise, and correct any part of these Terms and Conditions at its sole discretion and at any time, without prior notice, as it deems necessary for compliance with applicable laws, technical regulations, changes in the services provided, corporate decisions, or for any other relevant reason.

9. Cancellations and Event Changes

9.1. DecoHub strives to ensure the execution of virtual and immersive events and exhibitions as scheduled. However, DecoHub is not responsible for cancellations, changes in scheduling, or delays in events or exhibitions due to circumstances beyond its control. These circumstances may include, but are not limited to, acts of God, force majeure, internet connectivity disruptions, technical issues, government decisions, labor disputes, acts of war or terrorism, or other unforeseen circumstances that may affect the availability of online content.

9.2. In the event of total or partial event or exhibition cancellation or if an exhibitor or designer is unable to participate, DecoHub will make efforts to inform Users as soon as possible through available means, such as email, notifications on the Website, or through our official social media accounts. However, it cannot be guaranteed that all Users will receive such notification before the start of the event or exhibition.

9.3. In case of cancellation, change, or rescheduling of an event or exhibition, DecoHub shall not be held responsible.

9.4. Users are advised to regularly check the Website and their emails to stay informed about any updates or changes in event or exhibition schedules.

10. Applicable Law and Jurisdiction

10.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

10.2. Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, or the breach, termination, or validity thereof, shall be submitted to the exclusive jurisdiction of the courts and tribunals of the city of Barcelona, Spain.

10.3. The User acknowledges that, by accepting these Terms and Conditions, they waive any other jurisdiction that might correspond to them due to their present or future domicile, or for any other reason.
